Acceptance of Terms
By downloading, installing, or using Dave's List ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
1. Description of Service
Dave's List is a mobile application that helps users discover restaurants through friend recommendations and personalized suggestions.
Features Include:
- Restaurant discovery based on location
- Rating system (thumbs up/down)
- Social features (friends, sharing)
- Personalized recommendations
- Interactive map
- Business promotion subscriptions (optional)
2. Eligibility
- You must be at least 13 years old to use Dave's List
- Users under 18 require parental consent
- Business subscribers must be at least 18 years old
3. User Responsibilities
3.1 Acceptable Use
You agree to:

- ✅ Provide honest ratings and reviews

3.2 Prohibited Conduct
You must NOT:

- ❌ Create multiple accounts to game the system
4. Business Subscriptions
4.1 Subscription Plans
We offer three auto-renewable subscription tiers:

4.2 Billing
- Billing Cycle: Monthly (30 days)
- Payment Method: Through Apple App Store (In-App Purchase)
- Auto-Renewal: Subscriptions automatically renew
- Taxes: Additional taxes may apply based on location
4.3 Cancellation
To cancel your subscription:
- Open iOS Settings
- Tap your name → Subscriptions
- Select Dave's List subscription
- Tap "Cancel Subscription"
Effect of Cancellation: Access continues until current period ends. No charge for next period.
4.4 Refund Policy
Apple's Refund Policy Applies:
- Purchases made through App Store
- Refunds at Apple's discretion
- Request refund: reportaproblem.apple.com
- We cannot process refunds directly
5. Intellectual Property
Dave's List owns all rights to:
- App design, code, and functionality
- Branding, logos, and trademarks
- Algorithms and recommendation engine
License to You: Limited, non-exclusive, non-transferable license for personal use only.
6. User Content
6.1 Your Content
When you post content (ratings, photos, reviews):
- You keep ownership
- You're responsible for legality and accuracy
- Must comply with these Terms
6.2 License to Your Content
By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content within the App.
You can delete content anytime (license terminates for deleted content).
7. Privacy

8. Disclaimers
8.1 "As-Is" Service
Dave's List is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
We do not warrant:
- Uninterrupted or error-free service
- Accuracy of restaurant information
- Specific results from recommendations
8.2 Restaurant Information
- Restaurant data from third-party sources (Google Places)
- We don't guarantee accuracy or completeness
- Always verify before visiting
8.3 No Professional Advice
App provides entertainment and information only. Not professional dietary or health advice.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
9.1 Maximum Liability
Our total liability to you shall not exceed:
- For free users: $0
- For business subscribers: Amount paid in past 12 months
9.2 No Consequential Damages
We are not liable for lost profits, lost data, or indirect damages.
10. Termination
10.1 By You
You can stop using the App anytime by deleting it from your device.
10.2 By Us
We may suspend or terminate your account if you violate these Terms.
11. Dispute Resolution
11.1 Informal Resolution
Before filing a claim, contact us at support@jaxily.com and allow 30 days for resolution.
11.2 Governing Law
These Terms are governed by the laws of the United States.
11.3 Class Action Waiver
Disputes must be resolved individually. No class action lawsuits.
12. Changes to Terms
We may update these Terms at any time. Material changes will have 30 days notice. Continued use after changes = acceptance.
13. Apple-Specific Terms
Since Dave's List is distributed via Apple App Store:
- These Terms are between you and Jaxily (not Apple)
- Apple is not responsible for the App
- We're responsible for maintenance and support
- Apple has no warranty obligations
14. Business-Specific Terms
14.1 Promotion Guidelines
Your promotion must be accurate, truthful, and comply with advertising laws.
14.2 Performance
We strive for best performance but don't guarantee specific impressions, click-through rates, or ROI results.
